PRIVACY POLICY

(Legislative Decree No. 196 of June 30, 2003 and Regulation (EU) 2016/679 – GDPR)

In compliance with Article 13 of Legislative Decree No. 196 of June 30, 2003, better known as the Personal Data Protection Code, and Article 13 of Regulation (EU) 2016/679, known as the GDPR, we inform you that your data will be processed by us, in accordance with the principles of lawfulness and fairness, in paper and electronic form and collected at our registered office, only to fulfill obligations imposed by law, regulations, and EU legislation, to execute the contract to which you are a party, and to manage the relationships between us at every stage (periodic checks, assistance, monitoring of the progress of relationships, customer satisfaction, dispute resolution, accounting and tax management, etc.).

The Data Controller for the data of individual customers, or of individuals acting on behalf of legal entity customers, is Ergo srl, with registered office in Pisa, Via G. Oberdan 11, CAP 56127; the Data Processor is Renato Cascino.

We share your data with our internal employees, with external parties recognized as recipients of the communication by national or EU law, and with and to external parties for functional, administrative, accounting, and tax purposes (a list of these parties is available upon request). 

Ergo srl does not transfer personal data to third countries or international organizations unless necessary to perform the service agreed with you (e.g., activities abroad); in this case, it will be assessed in advance whether the recipients of the data provide adequate guarantees, as required by Article 46 of the GDPR 679/16. 

The Data Controller retains and processes personal data for the time necessary to fulfill the contract. Subsequently, personal data will be retained, and not further processed, for the period established by applicable civil and tax provisions.

The provision of data is mandatory as it is necessary to perform the agreed-upon service; failure to provide it will prevent the contract from being executed.

With reference to Article 7 of Legislative Decree 196/2003 and Articles 15 (Right of Access), 16 (Right to Rectification), 17 (Right to Erasure), 18 (Right to Restriction of Processing), 20 (Right to Data Portability), 21 (Right to Object), and 22 (Right to Object to Automated Decision-Making) of the GDPR, the data subject may exercise his or her rights by writing to the Data Controller at the address above, or by email, specifying the subject of his or her request and the right he or she intends to exercise. You have the right to know at any time what personal data we hold about you and how it is used. You also have the right to have your data updated, supplemented, corrected, or deleted, to request suspension, or to object to its processing, by sending a request to our company by registered mail, fax, or email, using the contact details printed on this document.

If you believe that the processing of your data violates the GDPR, you have the right to lodge a complaint with the Italian Data Protection Authority (or the supervisory authority of your country of residence) pursuant to Article 77 of the GDPR.

We hereby inform you that Ergo srl does not perform automated decision-making processes on the data of individual customers or of natural persons acting on behalf of legal entity customers.

Finally, we remind you that for the management of contractual relationships, only a privacy notice is required. No authorization is required for the processing of data by ERGO S.r.l. if, as in our case, such processing is limited to the management of a contractual relationship. This document is merely being brought to your attention and does not need to be returned to us.
